Terms and Conditions
 

New accounts are due upon receipt via cash, company check or any of the following credit cards; Visa, MasterCard, American Express and Discover.

NOTICE:

Due to the fact that we have two different printing technologies, items ordered at different quantities may be printed by each method. Exact color matching is not possible, however, we will do everything possible to match as close as possible. Unless a definitive method is selected for printing, we may, at our discretion, use whichever method fits our production best to meet deadlines. By default, we will use whichever method is the lowest price to produce the order.

By placing an order with Jackson Press, you agree to the following terms:

1. Turnaround: Jackson Press estimates that all orders containing only flat pieces will be ready to ship within 72 hours (three business days) from the business day we receive the completed order. All orders placed before 6 p.m. (GMT-06:00) Indiana (East) will be considered ordered that business day. Any order placed after 6 p.m. will be considered ordered on the following business day. Jackson Press will do everything in its power to correctly produce your job in a timely manner, but can not guarantee a specific shipping or arrival date. The 72 hour turnaround is an estimate, and is not to be confused with a guarantee. Please remember extra finishing requires extra production time. Finishing includes but is not limited to: Folds, Scores, and additional coatings. Only the owners have the authority to promise turnaround times. If any other source gives the customer a turnaround time or promises turnaround estimate then it is not to be construed as a guarantee.

2. Rush: The ($30 or 10% above $300) rush fee will be not be charged if your order isn't ready for pickup or shipped by the next business day after you place an order with approval.

3. Quotations/Estimates: Prices posted on this web site are subject to change without notice. Written estimates are good for 30 days.

4. Orders: Jackson Press reserves the right to use its sole discretion in refusing to print anything it deems improper or known to be illegal. Jackson Press is not liable for any damages resulting from unwitting violation of copyright laws or illegal use of trade names or slogans. The client guarantees the legal title of all matter submitted to Jackson Press for printing and/or publication. Jackson Press is not a union print shop and therefore cannot print any material with the union bug.

5. Refund/Return Policy: Canceled orders require compensation for incurred costs and related obligations at the time of cancellation.

6. Accuracy of Specifications: Quotations are based on the accuracy of the specifications provided. Jackson Press can re quote a job at the time of submission if the art does not conform to the information on which the original estimate was based. Orders placed with Jackson Press are to the client's knowledge correct, and there are no conditions or agreements relating to the order which are not written or accompanying said order. Orders submitted from which an estimate was based; must reference the estimate #, otherwise estimate may not be honored.

7. Liability: Jackson Press's liability shall be limited to the stated selling price to the customer of any defective goods, and shall in no event include special, consequential, incidental, indirect or similar damages, including without limitation, lost profits. Jackson Press warrants that every product manufactured by it meets industry standard for such product and is free of any material defect in workmanship. IT IS EXPRESSLY AGREED THAT THIS WARRANTY IS IN LIEU OF ALL WARRANTIES OF FITNESS FOR PARTICULAR USE AND MERCHANTABILITY. Jackson Press makes no other warranty and no actions or words of Jackson Press or its officers, employees or agents shall constitute a warranty.

8. Indemnification: The customer represents that it has the legal right to produce all printed materials ordered from Jackson Press. In the event that a charge, claim or demand, or arbitration, action or proceeding (collectively, a "Claim") is made or commenced against Jackson Press based upon, relating to or arising from the alleged wrongful acts of the customers, or alleging that the printing performed or product produced by Jackson Press ordered by the customer: (a.) infringes any copyright, patent or other proprietary right of any person; or (b.) contains matter that is libelous, slanderous, defamatory, scandalous or obscene, the customer shall indemnify and hold Jackson Press harmless from and against any loss, damages, cost and expense arising from or related to the Claim including without limitation; (1.) defending Jackson Press against any such Claim (2.) paying any judgment or award against the customer; and (3.) reimbursing Jackson Press for any legal fees and expenses it reasonably incurs in responding.

9. Electronic Manuscripts/Images: Jackson Press is not responsible for accidental loss or damage to media supplied by the client or for errors on supplied artwork furnished by the client. Until Jackson Press can evaluate digital input, no claims or promises are made about our ability to work with jobs submitted in digital format, and no liability is assumed for problems that may arise. Any additional translating, editing, or programming needed to utilize client-supplied files will be charged at our current rates. Jackson Press will archive your work for a period of at least 5 years.

10. Alterations/Corrections: Client alterations must be specified in writing and must include all corrections or changes from the original specifications. Such work will be charged at our current rates.

11. Pre press Proofs: When requested by the customer, Jackson Press will submit color proofs for the customer's review and approval at a charge of $3 each. Proofs must be signed and faxed or returned to Jackson Press marked "O.K." or "Revised Proof Required" and signed by the customer. Until the proof are faxed or returned, no additional work will be performed. Jackson Press will not be responsible for undetected production errors if: Proofs are waived by the client; The work is printed per the client's written OK; Requests for changes are communicated verbally. All requests for changes of any kind must be made in writing to avoid mistakes. Any proof request waives our turnaround guarantee.

12. The Guarantee of Color and Exact Color Matching: Unless a print proof has been provided or exact color specifications have been identified, Jackson Press will not be responsible for colors or printing that does not print as expected. See the file specifications for details. Our proofs are produced by digital equipment and the actual print order may be produced by offset printing, variation to color may occur.

13. Overruns/Under runs: Jackson Press will normally deliver the exact quantity of goods ordered plus a small additional amount. There is no extra charge for the additional amount. In the event of an under run, Jackson Press may bill for the actual quantity delivered. The generally accepted trade practice is plus or minus 5%.

14. Cutting and Product Alignment: 1/16" to 1/8" will be trimmed from the final product size for flat card products. In order to align folds more or less may be trimmed from jobs that require folding. In order to get folds to match we will take liberty to trim the final product to get it to the customer in a visually acceptable format. Up to 1/8" may be trimmed from folded jobs in order to secure the integrity of the folds. We highly suggest against having borders on your products. We can not guarantee that the borders will be exact. Depending on other jobs on the run sheet will be the determining factor of the cuts. We are a full bleed printer and are not responsible for uneven or misaligned borders.

15. Delivery: Charges for delivery of materials and supplies from the client or the client's supplier to Jackson Press are not included in quotations unless specified. Jackson Press is not responsible for delays and/or damage incurred during shipping. We double box all product shipped. Title for finished work passes to the customer upon delivery to the carrier at shipping point; or upon mailing of invoices for the finished work or its segments, whichever comes first.

16. Claims: Claims for defects, damages, or shortages must be made by the client in writing no later than 10 calendar days after delivery. If no such claim is made, Jackson Press and the client will understand that the job has been accepted. By accepting the job, the client acknowledges that Jackson Press's performance has fully satisfied all terms, conditions and specifications. You must inspect the product upon receipt. If any of the product is used then a claim is null and void. The entire contents of the shipping package must be included in order to file a claim. A group of samples are collected and saved by our customer service and sales departments in order to ensure quality. The samples are used as representatives of the order placed if a dispute is called.

17. Disputes & Venue: For legal purposes, the venue for any dispute shall be Marion County, Indiana, USA

18. Right to Subcontract: Jackson Press shall have the right to subcontract any or all portions of an order at the sole discretion of Jackson Press.

19. Workmanship Guarantee: Jackson Press will do it's best to provide high quality, error free printing. Quality issues due to hickeys, offset, smudges and size discrepancies will be corrected accordingly.

20. Privacy Statement: Any information Jackson Press collects from order processing or from any inquiries is not shared with any other company. Your information is only used for contact, billing, and shipping purposes.

21. Billing: Accounts with terms are set at net 30. Prepay customers will be charged via credit card and statement posting will read "Jackson Press"

22. Design Specifications: Business card files must have an 1/16" bleed and an 1/16" safe area. Files which do not meet these requirements will be corrected by our pre press department or rejected if it is outside our ability to correct. This may introduce minor image changes to the final printed piece. All files submitted for sizes larger than a business card must have a 1/16" safe area. We take no responsibility for cutting text or images which exist outside our required safe area. Please check your design before submitting it for print. Finished sizes for pieces larger than business cards may vary by 1/16". If you require a custom size, please call for a custom quote. We accept a wide variety of file formats. If we have to convert your file from it's native format to a print ready file, variations may occur. Variations are but not limited to: layout changes, fonts replaced, fonts missing, colors shifting, text being trimmed, and general composition errors. We will automatically require a PDF proof be approved by the client. By agreeing to our terms and conditions you understand that art submitted that does not meet our safe area and bleed standards will be corrected by our graphics department. This may include but not limited to adding borders, pixel stretching around the borders, and image re sizing. The customer understands that contact will only be made if the problem cannot be resolved by our graphics department.

23. Shipping Changes and Shipping Methods: We ship your order the best ground method possible. Orders requiring rush delivery will incur additional shipping charges.

24. Third Party Billing and Reimbursements: Your card will be billed the exact amount of the purchase. Jackson Press will not charge a card for more than the amount and reimburse the difference as a commission. It is up to the customer to work out an agreeable transaction arrangement with his/her client when he/she resells our products.

25. Changes: Jackson Press may change, modify, add or remove portions of this policy at any time, and any changes will become effective immediately upon being posted unless stated otherwise. This policy was last revised on January 1st, 2009.
